Niniejszy regulamin okre\u015bla zasady korzystania ze strony internetowej dgdedu.pl (dalej: \u201eStrona\u201d) oraz zasady sprzeda\u017cy aplikacji mobilnych, komputerowych i internetowych oferowanych przez Rafa\u0142 Sadowski (dalej: \u201eSprzedawca\u201d).<\/p><p>1.2. Administratorem strony i podmiotem odpowiedzialnym za jej tre\u015b\u0107 jest Rafa\u0142 Sadowski, z siedzib\u0105 w Wyszk\u00f3w, e-mail: <strong><em>dgdgplay@gmail.com<\/em><\/strong><\/p><p class=\"isSelectedEnd\"><em><strong>1.3. Korzystanie ze Strony oznacza akceptacj\u0119 niniejszego Regulaminu.<\/strong><\/em><\/p><ol start=\"2\" data-spread=\"false\"><li><em><strong>Produkty i zakup<\/strong><\/em><\/li><\/ol><p class=\"isSelectedEnd\">2.1. Produkty oferowane przez Sprzedawc\u0119 to aplikacje edukacyjne, gry edukacyjne oraz tre\u015bci cyfrowe dost\u0119pne mi\u0119dzy innymi w App Store, Google Play, Microsoft Store oraz w wersjach internetowych WebGL.<\/p><p class=\"isSelectedEnd\">2.2. Zakupu aplikacji dokonuje si\u0119 bezpo\u015brednio za po\u015brednictwem odpowiednich platform sprzeda\u017cowych, w szczeg\u00f3lno\u015bci:<\/p><ul data-spread=\"false\"><li><em><strong>App Store (Apple Inc.),<\/strong><\/em><\/li><li><em><strong>Google Play (Google LLC),<\/strong><\/em><\/li><\/ul><p class=\"isSelectedEnd\">2.3. Zakupy dokonywane za po\u015brednictwem App Store, Google Play oraz Microsoft Store podlegaj\u0105 r\u00f3wnie\u017c regulaminom i zasadom obowi\u0105zuj\u0105cym na tych platformach, w tym zasadom p\u0142atno\u015bci, zwrot\u00f3w i obs\u0142ugi transakcji.<\/p><p class=\"isSelectedEnd\">2.4. U\u017cytkownik zobowi\u0105zany jest do zapoznania si\u0119 z regulaminami odpowiednich platform przed dokonaniem zakupu.<\/p><p class=\"isSelectedEnd\">2.5. Zakup produktu oznacza nabycie niewy\u0142\u0105cznej, nieprzenoszalnej licencji na korzystanie z aplikacji, gry lub tre\u015bci cyfrowej.<\/p><p class=\"isSelectedEnd\">2.6. Kod aktywacyjny jest jednorazowy i mo\u017ce zosta\u0107 aktywowany wy\u0142\u0105cznie na jednym koncie u\u017cytkownika oraz jednym urz\u0105dzeniu.<\/p><p class=\"isSelectedEnd\"><em><strong>2.7. Kod aktywacyjny nie podlega ponownej aktywacji, odnowieniu ani przeniesieniu na inne urz\u0105dzenie.<\/strong><\/em><\/p><p class=\"isSelectedEnd\">2.8. W przypadku usuni\u0119cia danych przegl\u0105darki, pami\u0119ci lokalnej przegl\u0105darki (local storage), reinstalacji systemu operacyjnego, reinstalacji przegl\u0105darki lub zmiany urz\u0105dzenia u\u017cytkownik mo\u017ce utraci\u0107 dost\u0119p do aktywowanej licencji.<\/p><p class=\"isSelectedEnd\">2.9. Sprzedawca nie ponosi odpowiedzialno\u015bci za utrat\u0119 dost\u0119pu wynikaj\u0105c\u0105 z dzia\u0142a\u0144 u\u017cytkownika, w szczeg\u00f3lno\u015bci usuni\u0119cia danych lokalnych, zmiany urz\u0105dzenia lub korzystania z trybu prywatnego przegl\u0105darki.<\/p><p class=\"isSelectedEnd\">2.10. Produkty internetowe typu WebGL mog\u0105 wymaga\u0107 nowoczesnej przegl\u0105darki internetowej oraz w\u0142\u0105czonej obs\u0142ugi pami\u0119ci lokalnej przegl\u0105darki.<\/p><ol start=\"3\" data-spread=\"false\"><li><em><strong>Brak mo\u017cliwo\u015bci odst\u0105pienia od umowy<\/strong><\/em><\/li><\/ol><p class=\"isSelectedEnd\">3.1. Zgodnie z art. 38 pkt 13 Ustawy o Prawach Konsumenta, prawo do odst\u0105pienia od umowy w ci\u0105gu 14 dni nie przys\u0142uguje w przypadku tre\u015bci cyfrowych dostarczanych natychmiast po zakupie, je\u015bli konsument wyrazi\u0142 na to zgod\u0119.<\/p><p class=\"isSelectedEnd\">3.2. Przed finalizacj\u0105 zakupu u\u017cytkownik jest informowany o braku mo\u017cliwo\u015bci odst\u0105pienia od umowy.<\/p><ol start=\"4\" data-spread=\"false\"><li><em><strong>Reklamacje<\/strong><\/em><\/li><\/ol><p class=\"isSelectedEnd\">4.1. U\u017cytkownik mo\u017ce zg\u0142osi\u0107 reklamacj\u0119, je\u015bli aplikacja lub gra:<br \/>a) nie dzia\u0142a zgodnie z opisem,<br \/>b) posiada istotne b\u0142\u0119dy uniemo\u017cliwiaj\u0105ce jej prawid\u0142owe dzia\u0142anie.<\/p><p class=\"isSelectedEnd\">4.2. Reklamacje nale\u017cy zg\u0142asza\u0107 na adres e-mail: dgdgplay@gmail.com<\/p><p class=\"isSelectedEnd\">4.3. Sprzedawca zobowi\u0105zuje si\u0119 rozpatrzy\u0107 reklamacj\u0119 w ci\u0105gu 14 dni roboczych.<\/p><p class=\"isSelectedEnd\">4.4. Je\u015bli reklamacja zostanie uznana, Sprzedawca mo\u017ce:<br \/>a) udost\u0119pni\u0107 poprawion\u0105 wersj\u0119 aplikacji lub gry,<br \/>b) zaoferowa\u0107 wsparcie techniczne w celu usuni\u0119cia problemu.<\/p><ol start=\"5\" data-spread=\"false\"><li>Odpowiedzialno\u015b\u0107 Sprzedawcy<\/li><\/ol><p class=\"isSelectedEnd\">5.1. Sprzedawca nie ponosi odpowiedzialno\u015bci za problemy wynikaj\u0105ce z:<br \/>a) niekompatybilno\u015bci aplikacji lub gry z urz\u0105dzeniem u\u017cytkownika,<br \/>b) b\u0142\u0119dnej konfiguracji systemu u\u017cytkownika,<br \/>c) ingerencji w kod aplikacji lub gry przez osoby trzecie,<br \/>d) ogranicze\u0144 technicznych platform zewn\u0119trznych lub przegl\u0105darek internetowych,<br \/>e) utraty danych lokalnych przez u\u017cytkownika.<\/p><ol start=\"6\" data-spread=\"false\"><li>Postanowienia ko\u0144cowe<\/li><\/ol><p class=\"isSelectedEnd\">6.1. Sprzedawca zastrzega sobie prawo do zmiany Regulaminu.<\/p><p class=\"isSelectedEnd\">6.2. W sprawach nieuregulowanych Regulaminem obowi\u0105zuj\u0105 przepisy prawa polskiego oraz prawa Unii Europejskiej.<\/p><p>6.3.
